This is a half day seminar in Durban on the 19th May 2008, split into 2 sections dealing with two very important issues that the financial and credit departments of South African businesses have to ensure they are up to speed in, namely commercial fraud prevention and the effect on creditors of the proposed new business rescue, in terms of the Companies Bill.

1. COMMERCIAL FRAUD – IDENTIFYING AND PREVENTING
Fraud activity in South Africa has increased dramatically in the last couple of years; to such an extent that businesses are being targeted daily. Your business can not afford not to know the ways in which fraudsters are committing these very expensive crimes, which range from credit application fraud to internet banking and many other forms of fraud. In addition, the seminar will touch on preventative measures and policies that you can introduce in your company to reduce the risk of being a victim of these crimes.


We are fortunate to have Glen Moulton, a top expert in the area of commercial fraud, as a presenter on this topic. Glen heads up The Fraud Triangle, a firm which specialises in the investigation of fraud and the design and implementation of fraud prevention programs.


Previously Glen was a prosecutor, a practising attorney and a senior manager in the forensic department of Ernst & Young; where he worked for a period of 7 years.

He has, during his career as a forensic specialist, provided fraud investigation and prevention services to clients within both the public and private sectors. He has provided training and presented at conferences on the subject of fraud investigation and prevention, published articles in the print media and has been interviewed on SAFM on the subject of fraud prevention.

2. BUSINESS RESCUE FROM A CREDITOR’S PERSPECTIVE – CHAPTER 6 OF THE COMPANIES BILL
The Corporate Amendment Act, which brings changes to the Companies act, has recently been passed. However, the big change in the Companies Act will come when the Companies Bill becomes law. Corporate insolvency law and liquidations as we know them will be radically changed. This will impact on the credit policies and debt recovery procedures of all companies and this seminar will look at the changes and the challenges faced by companies as a result of these new concepts and law.

Presenting this section is Brett Bentley, an attorney specialising in credit law, debt recovery and insolvency law. Brett is with Bentley Attorneys and is also the CEO of Bentley Credit Control, a credit management company focusing on debt recovery. Brett is a former director of the Institute of Credit Management and has presented extensively on the topics of credit law, debt recovery and credit management around the country.
